Last Updated: March 13, 2024

This Privacy Policy (“Privacy Policy”) is intended to help you understand how Chalonne (“Chalonne,” “we” or “us” ) collects, uses and discloses Personal Information (defined below) when you use our website (e.g., Chalonne.com, including its chat function and website optimization features), other connected services, events, and our customer relationship channels (collectively, the “Services”). This Privacy Policy describes what Personal Information we collect, why we collect it, how we use it, when we share it with others, and what choices you can make about how we collect and use your Personal Information.

Before submitting Personal Information to us or using the Services, please review this Privacy Policy carefully. By using or accessing our Services, you consent to our collection and use of your Personal Information as described in this Privacy Policy. If you do not want us to collect or use your Personal Information, please do not provide it to us or access the Services. As we implement new technology and introduce new services, we will update our Privacy Policy, so we encourage you to review it often.

We do not knowingly collect any Personal Information from children under the age of 13 without verifiable parental consent. If we learn that a child under 13 has submitted Personal Information online to us without parental consent, we will take reasonable measures to delete the information as soon as possible and to avoid using such information, except where necessary to protect the safety of the child or others as required or allowed by law. If you believe a child under 13 has provided us with Personal Information, please contact us at legal@chalonne.com.

Information We Collect

We collect the following information:

Information You Share with Us: “Personal Information” is information that identifies, relates to, or is capable of being associated with you. Depending on how you interact with us, we may collected Personal Information such as your name, email address, records of products purchased, physical address/location, non-precise geolocation (e.g., geolocation derived from IP address), and phone number. Personal Information that we collect depends on how you use the Services. For example, when you make a purchase or attempt to make a purchase, we collect certain information from you, including your name, billing address, shipping address, payment information (such as your credit card number), email address, and phone number. Providing your Personal Information to us is your choice. If you choose not to provide us with certain Personal Information, you may not be able to take advantage of certain features of the Services.

Information We Collect Automatically: When you visit the Services, we may automatically collect identifier and other information, such as your browser information, IP address, operating system information, device information, information on the date, time, or duration of your visit, your time zone, what websites or search terms referred you, the pages or products you view, information about how you interact with the Services, and some of the cookies installed on your device (“Online Information”).

If you use the Services by connecting through another service (such as a social media or email account), you authorize us to use Personal Information from that other service to help complete your Chalonne profile. How the other service collects, uses, processes, stores, and discloses your Personal Information is governed entirely by the policies and practices of that other service. We urge you to read carefully the terms, conditions and policies of that other service, including any notices regarding its privacy and data practices. Chalonne shall have no responsibility or liability for the privacy or data practices or other actions of any third-party provider or any other third-party site or service that may be enabled within the Services.

You may request to review, update or change your account information, including your contact information, by contacting us at info@chalonne.com.

Online Identification Tools

We maintain log files that track actions occurring on your visit and collect data such as your IP address, browser type, internet service provider, date/time stamps, and referring/exit pages. We may use information from such files, including your IP address, to provide a better web experience, diagnose problems, and detect fraud.

We use Lucky Orange, a wesite analytics tool that provides session replay, heatmaps, funnels, form analytics, feedback surveys, and similar features/functionality. Lucky Orange may record your clicks, mouse movements, scrolling, form fills (keystrokes) in non-excluded fields, pages visited and content, time on site, browser, operating system, device type (desktop/tablet/phone), screen resolution, visitor type (first time/returning), referrer, anonymized IP address, location (city/country), language, and similar metadata. Lucky Orange does not collect information on pages where it is not installed, nor does it track or collect information outside your web browser or in the check-out section. If you'd like to opt-out, you can do so on the Lucky Orange privacy page. If you'd like to obtain a copy of your data, make a correction, or have it erased, please contact us first or, as a secondary option, contact Lucky Orange at privacy@luckyorange.com. For more information on Lucky Orange and GDPR, visit: https://www.luckyorange.com/legal/privacy.

We use cookies to track your shopping cart and for other purposes like personalizing the Services. A cookie is a small file stored by your internet browser on your computer. A “session cookie” stores temporary information that is erased when you close your web browser or turn off your computer. A “persistent cookie” allows the Services to recognize you when you return to it and is stored on your computer until you delete it. Your web browser is usually set up to initially accept cookies. If you set your browser to reject cookies, the Services will be unable to recognize your account or personalize the content you see. A “flash cookie,” also known as a “local storage object,” is not stored by your browser, unlike other cookies, and is placed on your computer by websites that use Adobe Flash. You may disable flash cookies via your Flash Player preferences or by using third-party software.

We may use web beacons (a.k.a. clear GIFs, web bugs or pixel tags) to record information about your visit, personalize your experience, and generate information about traffic and trends. Web beacons collect information, such as your browser type and IP address, and may be used alone or with cookies.

Behavioral Advertising

We may use Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For more information about how targeted advertising works, you can visit the Network Advertising Initiative’s (“NAI”) educational page at http://www.networkadvertising.org/understanding-online-advertising/how-does-it-work. We may share your Personal information with third party advertisers for cross contextual behavioral advertising. You can opt out of targeted advertising by using the links below:

Facebook: https://www.facebook.com/settings/?tab=ads

Google: https://www.google.com/settings/ads/anonymous

Additionally, you can opt out of some of these services by visiting the Digital Advertising Alliance’s opt-out portal at: http://optout.aboutads.info/.

How We Respond to Do Not Track Signals

Some browsers (such as Safari, Internet Explorer, Firefox and Chrome) include a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want his or her online activity and behavior to be tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the user. Not all browsers offer a DNT option, and DNT signals are not uniform. Many digital service operators, including Chalonne, do not recognize or respond to DNT signals.

Third-Party Features

The Services may include an activity feed and social media buttons. These features are either hosted by a third party or hosted directly on the Services, and your interactions with them are governed by the privacy policy of the third party that provides the feature.

Third-Party Links

We may provide links to third-party websites that we do not own or control. We are not responsible for the information collection practices of any website that we do not own or control. We encourage you to review and understand the privacy practices of third-party websites before providing any information to or through them.

We also use Personal Information to improve and optimize our Services. For example, we generate analytics about how our customers browse and interact with our Services, and to assess the success of our marketing, advertising, and promotional activities. Online Information may be combined with and/or linked to other Personal Information, consistent with the purposes described above.

We may use your deidentified Personal Information and Online Information to generate anonymized, aggregated data about our users (“Anonymized Data”). We may provide third parties with Anonymized Data in describing the Services to prospective partners, marketers, advertisers and other third parties, and for any other lawful purposes. The Anonymized Data does not include any information permitting the recipient to identify or contact you.

Third-Party Service Providers

You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy. We also use Google Analytics to help us understand how our customers use the Site. You can read more about how Google uses your Personal Information here:  https://www.google.com/intl/en/policies/privacy/. You can opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout. Also, as discussed above, we use Lucky Orange.

We may retain third parties to perform functions for us, such as processing credit card payments, collecting sales tax, fulfilling orders, delivering packages, sending mail and e-mail, providing search results and links, and serving ads. These third-parties have access to Personal Information needed to perform those activities.

Inviting Others

You may choose to invite someone else to use the Services by providing his or her name and email address. We may use this information to send invitations to such individuals and to track the results of such referrals. Anyone who receives an email invitation to use the Services may opt out of receiving future emails by following opt-out instructions in the email. We take reasonable steps to implement opt-out requests promptly, but those who opt out may continue to receive communications from us as we process the opt-out request, as required for order processing, and other purposes.

Retention of Personal Information

Chalonne retains Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. When you place an order through the Services, we may maintain information regarding your purchase for our records unless and until you ask us to delete the information.
